This was due to alleged violations of the <strong>Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)<\/strong>\u2014specifically regarding:<\/p><ul><li><p>The use of <strong>antimicrobial silver<\/strong> in their filters, and<\/p><\/li><li><p>Their <strong>unverified contaminant reduction claims<\/strong>.<\/p><\/li><\/ul><p>As a result, <strong>Berkey has been unable to produce or sell its Black Berkey filters<\/strong> since that time.<\/p><p>Berkey challenged the EPA in court, but their case was dismissed. They then petitioned the U.S. Supreme Court to intervene. Berkey hasn&#8217;t resumed filter production or sales.
